The following information on our Privacy Policy reflects the commitment of KENKO IMALYTICS TECH, SL (hereinafter “KENKO IMALYTICS”), as data controller, to maintaining and guaranteeing secure commercial relations through the protection of personal data, guaranteeing the right to privacy of each of the users of our services. In this document, we explain how we use personal data during the use of our services.

For transactions / contracting of services:

  • Purpose: To be able to carry out the relevant procedures for the contracting of the services selected by the customer.
  • Legal basis: The legal basis on which the data shall be processed lies in the performance of the requested pre-contractual measures and/or the consent given.
  • Communication of data to third parties: In order to deliver the purchased products, it is essential to communicate your data to the companies responsible for logistics, shipping and transport.
  • Retention periods: The data shall be retained for the time necessary to respond to the issues raised.

 

KENKO IMALYTICS shall inform all users of the non-mandatory nature of the collection of certain personal data, except in fields where otherwise indicated. However, failure to complete such data may prevent KENKO IMALYTICS from providing all those Services linked to such data, releasing us from all liability for the non-provision or incomplete provision of such Services.

The user is obliged to provide the data truthfully and keep it updated; therefore, KENKO IMALYTICS reserves the right to exclude from the services and cancel the service of any user who has provided false data, without prejudice to any other actions available in law. 

Your personal data shall NOT be communicated to any other company. If it were necessary to communicate your information to another entity, your express consent would be requested before carrying out the communication. Furthermore, KENKO IMALYTICS does not carry out international transfers of data or adopt automated decisions regarding the information provided by the User.

Processing in which KENKO IMALYTICS acts as Data Processor

In certain cases, and in particular when KENKO IMALYTICS provides its cloud software services for working time control to employing companies and organisations, KENKO IMALYTICS may act as Data Processor of personal data on behalf of the customer, who holds the status of Data Controller, in accordance with the provisions of Regulation (EU) 2016/679 (GDPR).

In these cases, personal data is processed exclusively following the instructions of the Data Controller and solely for the purpose of providing the contracted service, without KENKO IMALYTICS using such data for its own purposes.

When KENKO IMALYTICS acts as Data Processor, such relationship shall be regulated by the corresponding Data Processing Agreement, formalised in accordance with Article 28 of the GDPR, which is incorporated into the terms of service.

The customer, as Data Controller, is solely responsible for determining the legal basis for processing, complying with the duty of information towards data subjects and guaranteeing the exercise of the rights recognised by data protection regulations.

Security of your personal data

KENKO IMALYTICS declares that it has implemented and maintains an Information Security Management System in accordance with ISO/IEC 27001, which entails the adoption of a structured and documented set of technical and organisational measures intended to guarantee a level of security appropriate to the risk, in accordance with Article 32 of the GDPR.

In particular, such measures include, among others, formal information security policies; logical access controls based on roles and the principle of least privilege; secure authentication mechanisms; encryption of communications and, where appropriate, of stored information; security incident management procedures; regular backups and business continuity and disaster recovery plans; as well as processes for assessment and continuous improvement of the level of security.

KENKO IMALYTICS guarantees that these measures are reviewed and updated periodically in light of the evolution of risks, the state of the art and the applicable regulatory requirements. 

Information on the Use of cookies

By merely visiting this web portal or using the services of KENKO IMALYTICS, no personal data identifying a User is automatically recorded. However, we inform you that while browsing the Website, “cookies” are used, small data files that are generated on the internet user’s computer and allow us to obtain the following analytical information:

  1. The date and time of access to the Website, allowing us to know the busiest hours and make the necessary adjustments to avoid saturation problems during our peak hours.
